Terms and Conditions of Use
The terms and conditions apply to the use of the okeefefashion.com website (the Website). By placing an order with us, you are agreeing to accept these terms and conditions (The Conditions). Please note, these terms and conditions can potentially change at any time, and it is up to you to check The Conditions regularly before ordering products in case there are any changes. If you do not agree with the terms and conditions set out below, you should not use or access the Website.

The okeefefashion.com website is owned and operated by Mount Barton Limited, a company registered in England number 2626020 at 8/10 South Street, Epsom, Surrey KT18 7PF VAT number GB 585 8931 78 which trades as, and shall be referred to in these Conditions as O’Keefe. The following terms and conditions will apply between you and O’Keefe when you buy an item from okeefefashion.com. The Conditions do not affect your statutory rights.
Your contract for purchases made through okeefefashion.com is with O’Keefe and you undertake that all goods ordered by you are for your own private and domestic use only and are not for resale.
You must be eighteen years old or older to use this site. If you are under eighteen, you may only use this site with the agreement of, and under the supervision of, a parent or guardian. If you do not qualify, please do not use this site.
You warrant that all details you provide to okeefefashion.com for the purpose of ordering and purchasing goods are true, accurate, current and complete in all respects; and that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover payment of the items(s) ordered.
You agree that e-mail can be used as a long-distance means of communication.
Payment card transactions are processed by a secure third party who for their part in the transaction will advise you of their own terms and conditions in so far as they are applicable. O’Keefe cannot access any sensitive information regarding your payment card.
To keep matters simple and secure for you the Website does not require you to register your details, select and remember a username and password and does not store your personal information and card data. This approach does entail a little additional time to enter your details for each order and for this inconvenience we do apologise. O’Keefe reserve the right to end its agreement with you and to suspend or terminate your access to the site immediately and without notice to you if:-
- you fail to make payment to us when due
- you breach any of our terms and conditions
- when requested by us to do so, you fail to provide within a reasonable time frame, enough information to let us to check the accuracy and validity of any information supplied by you, or your identity
- we suspect you have engaged, or are about to engage, or have way of being involved in fraudulent or illegal activity on okeefefashion.com
Your responsibilities if you break these Conditions
You agree that if you break these Conditions, or any liabilities are incurred arising out of your use of this website, you will be responsible for the costs and expenses that we or our officers, directors, employees, agents and suppliers incur as a result of the breach, including reasonable legal fees (if applicable). You will remain liable if someone else uses your personal information unless you can prove that such use was fraudulent and without your knowledge.
When placing an order, you agree that any and all information given is accurate and complete.
All orders are subject to acceptance and product availability. Availability information for products is listed on each individual product description. Occasionally due to circumstances beyond our reasonable control the stock availability shown for a product may be incorrect allowing you to place an order when there is no stock available to fulfil your order and in these circumstances we reserve the right to refund your payment and cancel the order. Where the Website indicates that an item you have chosen is Out of Stock or On Order you will be unable to place an order for that item. Please call Customer Service for more information on the required item’s availability.
Due to the way that okeefefashion.com processes your credit or debit card payment the payment will be taken if the Website accepts your order and the card processor obtains the appropriate authority from the issuer of your payment card. If okeefefashion.com does not have enough stock to deliver the goods you have ordered or we are unable to fulfil the order for any reason we will contact you and will refund the payment that you have made within 72 hours.
All prices listed on okeefefashion.com are correct at the time of entering the information; however, we reserve the right to change prices of any product at any time. All prices include UK VAT
We are only able to accept orders for delivery to the following countries: United Kingdom, Australia, Austria, Bahamas, Bahrain, Barbados, Belgium, Bermuda, Brazil, Brunei, Canada, Cayman Islands, Channel Islands, China, Cyprus, Denmark, Finland, France, Germany, Gibraltar, Greece, Hong Kong, Iceland, Ireland, Israel, Italy, Japan, Jordan, Luxembourg, Kuwait, Mexico, Monaco, Netherlands, New Zealand, Norway, Oman, Portugal, Qatar, Saudi Arabia, Singapore, South Africa, South Korea, Spain, Sweden, Switzerland, Taiwan, Turkey, United Arab Emirates, United States of America.
No contract for the sale of any product will exist between you and okeefefashion.com until we dispatch the product to you. We will confirm receipt of your order and payment by sending you emails to the email address given in your order. You should check that all of the details on this confirmation email are correct and contact us as soon as possible if any information provided is wrong or inaccurate. When we dispatch the product(s) that you have ordered we will confirm this by email. If your order has not been accepted, you will receive an email from us telling you the reasons why.
The delivery period stated within which you will receive your order is approximate. Goods will be sent to the address given by you in your order. We are not able to deduct UK VAT from orders dispatched to addresses within the European Union. Orders dispatched to addresses outside the European Union will have any VAT included in the price deducted at the checkout stage of the order. Please be aware that your order may be subject to local import taxes and duty, which are your responsibility where they apply. If this is the case, our shipping company will contact you by telephone once your order has arrived in the destination country to let you know the cost and collect a payment from you. This may delay your delivery time as it is your responsibility to pay the proscribed charges for local authorities to release the goods.
Please be aware that if you don’t pay the import taxes and associated charges and in due course the items(s) are returned to us by our shipping company we reserve the right to charge any additional costs incurred by O’Keefe to you.
okeefefashion.com accept most major credit and debit cards. All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your credit or debit card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
Cancelling an Order
If you have placed an order but then wish to change or cancel it, please contact Customer Service as soon as you can. We will try our best to make any changes but we cannot guarantee that we will be able to do so as the order may already have been processed and dispatched. In such cases, you may have to wait until you receive the order and then follow the normal Returns procedures.
Once we've heard from you that you wish to cancel an order, any payment to us from your payment card will be re-credited to the same card account within 30 days of your order, provided the goods you return are in the same condition that they were when delivered to you. You will be liable for any charges incurred when returning the goods to okeefefashion.com, unless the return is as a result of an error that we have made or that we accept that goods were faulty.
Returns PolicyWhile we hope that you are delighted with your order, if you are not totally satisfied with the items you have bought we are happy to offer a full refund subject to the following provisos and conditions:
- Any items to be returned must be posted or dispatched by courier to our return address using the return label provided such that we receive them within 14 days of the order being accepted. All returns should be sent back to us in their original packaging and must be accompanied by the completed Return Advice form included with your order.
- Returned items received by us later than 14 days from the date of the order being accepted may be returned to you at our discretion. Please bear this in mind when choosing a mailing service.
- The item(s) should be returned unworn and in perfect condition, with all O’Keefe and designer garment tags still attached. Items delivered to you with an O’Keefe “Return Security Band” must be returned with the band’s seal unbroken.
- Returns that are damaged soiled or returned without their original labels or with the Return Security Band seal broken may not be accepted and may be sent back to the customer.
- Where provided, any designer packaging such as authenticity cards, dust bags and leather tags should be included in your return.
- Footwear should be returned unmarked and in their original and undamaged packaging as this is considered part of the product. Please try on any footwear on a carpet or similar floor surface to avoid marking leather soles.
- Briefs, swimming costumes and bikini bottoms should be tried on over underwear. Returns may not be accepted if the hygiene strip has been removed (swimming wear) and may be sent back to the customer.
- Before we send your order it is carefully checked. If you receive an item which is damaged or faulty please contact customer service immediately.
- If your item is faulty (i.e. received damaged or exhibits a manufacturing fault), O’Keefe may offer you optional alternatives to returning the item such as repair or discount. For more information, please contact Customer Service
Successfully returned items will be credited to the payment card used to originally make the purchase. If your order was delivered to an address in the European Union and you return all of the items ordered the delivery charges made on the order will also be refunded as required under the EU Distance Selling Regulations. Where it is not possible to make a refund to the card used for the order individual arrangements between you and O’Keefe will be agreed depending on the circumstances.
PrivacyO’Keefe will not pass on your personal details to any third party other than to our designated card processing partner who have for their part undertaken to maintain the strictest privacy and protection of your confidential data. We may from time to time send you newsletter and offers by e-mail. Every such email will contain an “unsubscribe” link which, once activated, will instruct us to permanently remove the email address from our e-mailing lists.
O’Keefe does not accept liability (except as set out below) for any errors and/or omissions contained in The Website and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice.
If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfil an order for a product that was advertisedatan incorrect price. You will be advised of the correct price of the subject product. You may re-order it if you wish. If you have already paid for the goods in the circumstances described in this clause, we shall refund the full amount within 15 days of the date of order. Should you choose to re-order at the correct price, a separate transaction will be posted to your credit card.
If you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question. You must notify Customer Service of any problem within 10 days of confirmation of the order plus return the goods to us, unless we inform you that return is not necessary. This provision does not affect your statutory rights.
O’Keefe has taken every precaution to provide accurate product images for each product for sale on the Website. However, due to different technical factors such as Internet browsers, monitor colour rendition etc., O’Keefe cannot be held responsible or liable for any differences in colour between the image and the actual product.
The products sold on okeefefashion.com are provided for private domestic and consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the Website or for any products or services purchased from okeefefashion.com
We have taken all reasonable steps to prevent Internet fraud and ensure any data collected from you is handled as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our security or the security of our card processing partner’s systems.
We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.
We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:
- Any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
- Any loss of goodwill or reputation; or
- Any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.
Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees
All rights, including copyright, in the content of the okeefefashion.com web pages are owned or controlled by O’Keefe. In accessing okeefefashion.com web pages, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way the content of the okeefefashion.com web pages for any other purpose whatsoever without the prior written permission of O’Keefe.
Third Party Information
We can not be held responsible for material displayed on third party websites or any other written material. The only prices that apply for O’Keefe / O’Keefe products are those stated on the okeefefashion.com material. We can not vouch for the reliability of prices stated on shopping directories or through any other third party.
No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.
Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.
These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation except where that representation has been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your statutory rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.
The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
